Court acquits man charged of rape in Port Harcourt.
A State magistrate court yesterday struck out the case of
a twenty-three year old man who was charged with rape and had been in Prison
custody since 2014.
The young man, Mr. Nyaamee Sunday was arrested and
arraigned along with his friend and roommate, Chinonso Udoye while four others are
at large.
Mr. Sunday pleaded not guilty to the charge but said his
friend, Mr. Udoye who was later granted bail by a State High court while he
remained in custody, had admitted to the crime.
Chief Magistrate, Felicitas Nwokwa who presided over the
matter said it was unfortunate that the accused remained in custody for about
three years and admonished him to shun wrong association and be an ambassador
to others against crime.
Chief Magistrate Nwokwa however said the magistrate court
lacked the jurisdiction to award the ultimate penalty for such cases and hence
warned the accused that he may not be lucky to escape trial if caught in wrong
doing again.
